A BILL FOR AN ACT ENTITLED: "AN ACT REVISING LAWS RELATED TO REGULATIONS IN UNINCORPORATED PLACES; CLARIFYING THAT THE BOARD OF COUNTY COMMISSIONERS may ADOPT RESOLUTIONS PROHIBITING OR CONTROLLING ROADSIDE SOLICITATIONS IN ACCORDANCE WITH section 61-8-507, MCA; AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS TO ESTABLISH REGULATIONS FOR ENFORCEMENT; PROVIDING AN APPROPRIATION; AMENDING SECTION 7-14-2106, MCA; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

Section 1. Section 7-14-2106, MCA, is amended to read:

"7-14-2106. Parking regulations Regulations in unincorporated places -- parking -- pedestrians soliciting rides, business, or contributions. (1) The board of county commissioners has jurisdiction and power, under such the limitations and restrictions as are prescribed by law, to establish by resolution parking regulations for the purpose of regulating the parking of motor vehicles in unincorporated towns and villages.

(2)        The board of county commissioners may adopt a resolution prohibiting or controlling pedestrian roadside solicitations for the entirety of any public easement, right-of-way, or highway under the board's jurisdiction in accordance with 61-8-507.

(a)        The board may establish regulations for the enforcement of any violation in unincorporated towns and villages and shall follow the provisions of 7-5-103 in establishing any regulations.

(b)        If no additional regulations are created under this section, the enforcement provisions under Title 61, chapter 8, must apply."

 

NEW SECTION. Section 2.Appropriation. There is appropriated $2,000 from the highway nonrestricted account established in 15-70-125 to the department of transportation for the biennium beginning July 1, 2023, to design signage.

 

NEW SECTION. Section 3.Effective date. [This act] is effective July 1, 2023.
