A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING smoking and vaping in cars with minors or PREGNANT persons; providing a definition; and PROVIDING AN APPROPRIATION."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Smoking in vehicles with minors or pregnant persons prohibited. (1) A person is prohibited from smoking or vaporizing any substance in a vehicle if there is another person in the vehicle who is a minor or a pregnant person.
(2) A person convicted of violating this section may be ordered to complete a smoking cessation program or be penalized as provided in 61-8-711.
(3) As used in this section, "smoking" has the meaning provided in 50-40-103.
NEW SECTION. Section 2. Appropriation. There is appropriated $1,000 to the department of justice from the general fund for the biennium beginning July 1, 2023 to defray costs of enforcing [section 1].
NEW SECTION. Section 3. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 61, chapter 8, part 1, and the provisions of Title 61, chapter 8, part 1, apply to [section 1].
