A BILL FOR AN ACT ENTITLED: "AN ACT creating the Montana local disaster resiliency fund; establishing eligible uses for the account; providing for a general fund transfer to the account; PROVIDING for a statutory appropriation; AMENDING SECTION 17-7-502, MCA; and PROVIDING AN IMMEDIATE EFFECTIVE DATE."

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

NEW SECTION. Section 1. Montana local disaster resiliency fund. (1) There is an account in the state special revenue fund established in 17-2-102 to be known as the Montana local disaster resiliency fund.

(2) There must be deposited in the account:

(a) general fund transfers; and

(b) retained interest earned on the balance of the account.

(3) Balances in the account over $100 million are statutorily appropriated to the department of military affairs pursuant to 17-7-502.

(4) Eligible uses of the account include:

(a) state and local mitigation projects that reduce or eliminate long-term risk to people and property from future disasters;

(b) the nonfederal cost share for personnel performing mitigation program management; and

(c) matching funds for grants for the purchase of hazardous material equipment and training to increase local capacity to respond to incidents as defined in 10-3-1203(7) involving hazardous material.

Section 2. Section 17-7-502, MCA, is amended to read:

"17-7-502. Statutory appropriations -- definition -- requisites for validity. (1) A statutory appropriation is an appropriation made by permanent law that authorizes spending by a state agency without the need for a biennial legislative appropriation or budget amendment.

(2) Except as provided in subsection (4), to be effective, a statutory appropriation must comply with both of the following provisions:

(a) The law containing the statutory authority must be listed in subsection (3).

(b) The law or portion of the law making a statutory appropriation must specifically state that a statutory appropriation is made as provided in this section.

(4) There is a statutory appropriation to pay the principal, interest, premiums, and costs of issuing, paying, and securing all bonds, notes, or other obligations, as due, that have been authorized and issued pursuant to the laws of Montana. Agencies that have entered into agreements authorized by the laws of Montana to pay the state treasurer, for deposit in accordance with 17-2-101 through 17-2-107, as determined by the state treasurer, an amount sufficient to pay the principal and interest as due on the bonds or notes have statutory appropriation authority for the payments. NEW SECTION. Section 3. Transfer of funds. By June 30, 2023, the state treasurer shall transfer $108 million from the general fund to the Montana local disaster resiliency fund established in [section 1].

NEW SECTION. Section 4. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 17, chapter 7, and the provisions of Title 17, chapter 7, apply to [section 1].

NEW SECTION. Section 5. Effective date. [This act] is effective on passage and approval.
