A BILL FOR AN ACT ENTITLED: "AN ACT revising the residential landlord and tenant act; requiring 60 days' notice for notice declining to offer a new lease or to offer a new rental agreement with different terms when a rental period is longer than month to month."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

NEW SECTION. Section 1.Duty of landlord to provide notice for rental agreements longer than month to month. (1) For a rental agreement entered into on or after October 1, 2023, when a rental period is longer than month to month, a landlord must provide a tenant 60 days' notice if the landlord wishes to:

(a)        decline to offer a new lease; or

(b)        offer a new rental agreement with terms different from those of the current rental agreement.

(2)        The section does not alter the remedies provided for a landlord or tenant by Title 70, chapter 24, part 4.

 

NEW SECTION. Section 2.Codification instruction. [Section 1] is intended to be codified as an integral part of Title 70, chapter 24, part 3, and the provisions of Title 70, chapter 24, part 3, apply to [section 1].
