AN ACT REQUIRING STATE AGENCIES TO INCLUDE WITH AN APPLICATION FOR A LICENSE OR PERMIT THE ESTIMATED TIME IT WILL TAKE FOR THE AGENCY TO PROCESS AND ACT ON THE APPLICATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Notice of estimated turnaround time on application for permit or license. (1) Except as provided in subsection (3), an application form issued by an agency that is an application for a permit or a license must include, either as an attachment or directly on the form, the estimated time it will take for the agency to process and act on a correctly completed application form.

     (2) In specifying the estimated turnaround time, an agency may use either the average turnaround time for applications or an estimate based on the percentage of applications processed within the most common turnaround time.

     (3) This section does not apply to an application processed on the same day that the application is received.     



     Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 15, and the provisions of Title 2, chapter 15, apply to [section 1].
