BY REQUEST OF THE REVENUE OVERSIGHT COMMITTEE



A BILL FOR AN ACT ENTITLED: "AN ACT IMPOSING A 4 3.75 PERCENT EXCISE TAX ON ALL SALES OF RETAIL TELECOMMUNICATIONS SERVICES; SUBMITTING THE TAX TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Retail telecommunications excise tax. An excise tax of 4% 3.75% is imposed on all sales of retail telecommunications services. The tax is imposed on the purchaser and must be collected by the telecommunications services provider.



     NEW SECTION.  Section 2.  Submission of tax to electorate. This act shall be submitted to the qualified electors of Montana as provided in Title 13, chapter 1, MCA, at the tax election to be held in 1999, by printing on the ballot the full title of this act and the following:

SHALL A NEW TAX, DESCRIBED AS FOLLOWS, BE IMPOSED?

     [] FOR imposing a revenue-neutral 4% 3.75% excise tax on sales of retail telecommunications to fund a decrease in telecommunications property taxes and license taxes.

     [] AGAINST imposing a revenue-neutral 4% 3.75% excise tax on sales of retail telecommunications to fund a decrease in telecommunications property taxes and license taxes.



     NEW SECTION.  Section 3.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.



     NEW SECTION.  Section 4.  Coordination instruction. If _ Bill No._ [LC 382] HOUSE BILL NO. 128 is not passed and approved, then this act is void.



     NEW SECTION.  Section 5.  Effective date. If approved by the electorate, this act is effective January 1, 2000.
