A BILL FOR AN ACT ENTITLED: "AN ACT INCREASING THE LICENSE FEE FOR APPLICANTS FOR RENEWAL OF A LICENSE AS A COMMERCIAL FEED MANUFACTURER OR DISTRIBUTOR, IF THE APPLICATION IS RECEIVED PRIOR TO JANUARY 1 OF EACH YEAR, TO $50; SUBMITTING THE FEE INCREASE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  License fee -- annual renewal. The fee for an application for renewal of a license issued under 80-9-201, if the application is received by the department prior to January 1 of each year, is $50.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana, as provided in Title 13, chapter 1, MCA, at the tax election to be held in 1999, by printing on the ballot the full title of this act and the following:

SHALL THE LICENSE FEE TAX FOR APPLICANTS FOR RENEWAL OF A LICENSE AS A COMMERCIAL FEED MANUFACTURER OR DISTRIBUTOR, IF THE APPLICATION IS RECEIVED PRIOR TO JANUARY 1 OF EACH YEAR, BE INCREASED ANNUALLY BY $25 IN THE FOLLOWING MANNER?

     [] FOR establishing the license fee for renewal of licensure for a commercial feed manufacturer or distributor, if received before January 1, annually, at $50.

     [] AGAINST establishing the license fee for renewal of licensure for a commercial feed manufacturer or distributor, if received before January 1, annually, at $50.



     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 80, chapter 9, part 2, and the provisions of Title 80, chapter 9, part 2, apply to [section 1].



     NEW SECTION.  Section 4.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 18, of the Montana constitution, is declared invalid, then [sections 2 and 5] of this act are void.



     NEW SECTION.  Section 5.  Effective date. This act is effective upon approval of the electorate.
