A BILL FOR AN ACT ENTITLED: "AN ACT INCREASING THE INSPECTION FEE ON CERTAIN COMMERCIAL FEEDS TO 18 CENTS A TON, AN INCREASE FROM THE FEE OF 15 CENTS A TON PREVIOUSLY ESTABLISHED BY RULE; SUBMITTING THE FEE INCREASE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Inspection fee on commercial feeds. An inspection fee must be paid on all commercial feeds, including customer formula feeds, but not including pet foods and specialty pet foods. The inspection fee is 18 cents a ton.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana as provided in Title 13, chapter 1, MCA, at the tax election to be held in 1999, by printing on the ballot the full title of this act and the following:

SHALL THE INSPECTION FEE TAX ON CERTAIN COMMERCIAL FEEDS BE INCREASED ANNUALLY BY 3 CENTS A TON, IN THE FOLLOWING MANNER?

     []     FOR establishing the inspection fee on certain commercial feeds at 18 cents a ton.

     []     AGAINST establishing the inspection fee on certain commercial feeds at 18 cents a ton.



     NEW SECTION.  Section 3.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 80, chapter 9, part 2, and the provisions of Title 80, chapter 9, part 2, apply to [section 1].



     NEW SECTION.  Section 4.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then [sections 2 and 5] of this act are void.



     NEW SECTION.  Section 5.  Effective date. This act is effective upon approval by the electorate.
