AN ACT ALLOWING THE REGULATION OF BARKING DOGS BY COUNTY ORDINANCE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Barking dog control. The governing body of a county may, by adoption of an ordinance that substantially complies with 7-5-103 through 7-5-107, regulate barking dogs. An ordinance adopted pursuant to this section may not apply to a dog that is owned, kept, or harbored as part of the business of a licensed veterinarian, animal boarding facility, or agricultural or livestock operation.



     Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 7, chapter 23, part 21, and the provisions of Title 7, chapter 23, part 21, apply to [section 1].
