A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING ANNUAL REPORTING OF MITIGATION OR
MONITORING REQUIREMENTS OR STIPULATIONS
; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Mitigation, monitoring, and stipulation compliance reporting. (1) Each agency of state government charged with the responsibility of issuing a lease, permit, contract, license, or certificate in which an environmental impact statement is required under 75-1-201 shall make available to the public an annual report on July 1 of each year summarizing compliance with any mitigation measures, monitoring requirements, or stipulations contained in any environmental impact statement and any related record of decision or decision notice or contained in a lease, permit, contract, license, or certificate that triggered the environmental impact statement.
(2) If an agency of state government has an electronic
assess ACCESS system as defined in 2-17-321, the agency shall
make the annual report required in subsection (1) electronically available on its electronic assess ACCESS system.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 75, chapter 1, part 2, and the provisions of Title 75, chapter 1, part 2, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective on passage and approval.
