A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING MUNICIPALITIES TO REIMBURSE RURAL FIRE DISTRICTS FOR THE TAX LOSS AND TO REIMBURSE FIRE SERVICE AREAS FOR THE RATE LOSS RESULTING TO THE DISTRICT OR AREA WHEN THE MUNICIPALITY ANNEXES A PORTION OF THE DISTRICT OR AREA; AND ALLOWING MUNICIPALITIES TO CONTRACT WITH RURAL FIRE DISTRICTS OR FIRE SERVICE AREAS TO PROVIDE SERVICES TO THE ANNEXED PORTION OF THE DISTRICT OR AREA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Municipal reimbursement to rural fire district. (1) Except as provided in subsection (3), if a municipality annexes property from a rural fire district, the municipality shall reimburse the amount of tax loss to the district, minus any amount needed for purposes of bonded indebtedness as provided in 7-33-2129.

     (2) Payment of the amount of tax loss to the rural fire district must be made in the month of December following the annexation and annually in December in subsequent years.

     (3) A municipality may choose to contract with the rural fire district to have fire services in the annexed portion of the district continue to be provided by the rural fire district for a sum equal to the amount of the tax loss. The municipality shall notify the rural fire district at the time of annexation as to whether or not it intends to have the district continue to provide fire services to the annexed portion of the district.



     NEW SECTION.  Section 2.  Municipal reimbursement to fire service area. (1) Except as provided in subsection (3), if a municipality annexes property from a fire service area, the municipality shall reimburse the amount of rate loss to the area, minus any amount needed for purposes of bonded indebtedness as provided for in 7-33-2404.

     (2) Payment of the amount of rate loss to the fire service area must be made in the month of December following the annexation and annually in December in subsequent years.

     (3) A municipality may choose to contract with the fire service area to have fire services in the annexed portion of the area continue to be provided by the fire service area for a sum equal to the amount of the rate loss. The municipality shall notify the fire service area at the time of annexation as to whether or not it intends to have the fire service area continue to provide fire services to the annexed portion of the area.



     NEW SECTION.  Section 3.  Codification instruction. (1) [Section 1] is intended to be codified as an integral part of Title 7, chapter 33, part 21, and the provisions of Title 7, chapter 33, part 21, apply to [section 1].

     (2) [Section 2] is intended to be codified as an integral part of Title 7, chapter 33, part 24, and the provisions of Title 7, chapter 33, part 24, apply to [section 2].
