A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING THE USE OF SAND THAT EXCEEDS ONE-EIGHTH OF AN INCH IN DIAMETER FOR SANDING HIGHWAYS IN THE WINTER."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Use of sand on Montana highways. The department may not use sand that exceeds one-eighth of an inch in diameter in maintaining public highways under its jurisdiction during the winter months.



     NEW SECTION.  Section 2.  Use of sand on county roads. A county road supervisor may not use sand that exceeds one-eighth of an inch in diameter in maintaining roads under the jurisdiction of the county during the winter months.



     NEW SECTION.  Section 3.  Codification instruction. (1) [Section 1] is intended to be codified as an integral part of Title 60, chapter 2, part 2, and the provisions of Title 60, chapter 2, part 2, apply to [section 1].

     (2) [Section 2] is intended to be codified as an integral part of Title 7, chapter 14, part 21, and the provisions of Title 7, chapter 14, part 21, apply to [section 2].
