A BILL FOR AN ACT ENTITLED: "AN ACT REMOVING THE TERMINATION DATE FOR THE FEE FOR REIMBURSEMENT OF REMEDIAL ACTION COSTS INCURRED BY THE DEPARTMENT OF ENVIRONMENTAL QUALITY FOR REVIEW AND OVERSIGHT OF A VOLUNTARY CLEANUP PLAN; SUBMITTING THE REMOVAL OF THE TERMINATION DATE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; REPEALING SECTION 27, CHAPTER 584, LAWS OF 1995; AND PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Repealer. Section 27, Chapter 584, Laws of 1995, is repealed.
NEW SECTION. Section 2. Submission to electorate. This act shall be submitted to the qualified electors of Montana at a tax election to be held in 1999 by printing on the ballot the full title of this act and the following:
SHALL THE FEE FOR REIMBURSEMENT OF REMEDIAL ACTION COSTS TAX BE INCREASED ANNUALLY BY $0, IN THE FOLLOWING MANNER?
 FOR removing the termination date for the fee for reimbursement of remedial action costs.
 AGAINST removing the termination date for the fee for reimbursement of remedial action costs.
NEW SECTION. Section 3. Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then section 2 of this act is void.
NEW SECTION. Section 4. Effective date. If approved by the electorate, this act is effective on the date of approval.
