A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING CERTAIN MOTOR VEHICLES TO BE PERMANENTLY REGISTERED; PROVIDING THAT FEES IN LIEU OF TAX AND OTHER MOTOR VEHICLE REGISTRATION FEES RELATED TO PERMANENT REGISTRATION BE PAID IN ADVANCE; SUBMITTING THE CHANGE IN THE ACCELERATION OF THE PAYMENT OF THE FEE IN LIEU OF TAX AND OTHER REGISTRATION FEES TO THE QUALIFIED ELECTORS OF MONTANA; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING A DELAYED EFFECTIVE DATE AND AN APPLICABILITY DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Permanent registration -- transfer of vehicle ownership. (1) The owner of a light vehicle 11 years old or older subject to the fee in lieu of tax, as provided in [section 2 of LC 564], may permanently register the vehicle upon payment of a $50 fee in lieu of tax and an amount equal to five times the applicable fees imposed for each of the following:

     (a) vehicle registration fees under 61-3-321(1)(b) and (5);

     (b) junk vehicle disposal fees under 61-3-508;

     (c) weed control fees under 61-3-510; and

     (d) county motor vehicle computer fees under 61-3-511.

     (2) In addition to the fees described in subsection (1), an owner of a truck with a manufacturer's rated capacity of 1 ton or less that is permanently registered shall pay five times the applicable fees imposed under 61-10-201.

     (3) The owner of a vehicle that is permanently registered under this section is not subject to additional fees in lieu of tax under [section 1 of LC 564] or to other motor vehicle registration fees described in this section for as long as the owner owns the vehicle.

     (4) The county treasurer shall:

     (a) credit the $50 fee in lieu of tax collected under this section to the motor vehicle suspense fund as provided in 61-3-509;

     (b) once each month, remit to the state treasurer the amounts collected under this section for the purposes of 61-3-121 (1)(b) and (5), 61-3-508, 61-3-510, 61-3-511, and 61-10-201.

     (5) (a) The permanent registration of a vehicle allowed by this section may not be transferred to a new owner. If the vehicle is transferred to a new owner, then the vehicle is subject to all applicable fees in lieu of tax and vehicle registration fees.

     (b) Upon transfer of a vehicle registered under this section to a new owner, the new owner shall exchange the existing number plates assigned to the vehicle for new number plates.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:

SHALL THE PAYMENT OF THE FEE IN LIEU OF TAX AND OTHER MOTOR VEHICLE REGISTRATION FEES FOR PERMANENTLY REGISTERED VEHICLES BE ACCELERATED IN THE FOLLOWING MANNER?

     [] FOR accelerating the payment of the fee in lieu of tax and other motor vehicle registration fees for permanently registered vehicles.

     [] AGAINST accelerating the payment of the fee in lieu of tax and other motor vehicle registration fees for permanently registered vehicles.



     NEW SECTION.  Section 3.  Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.



     NEW SECTION.  Section 4.  Coordination instruction. If LC 564 is not passed and approved, then this act is void.



     NEW SECTION.  Section 5.  Effective date. If approved by the electorate, this act is effective January 1, 2000.



     NEW SECTION.  Section 6.  Applicability. This act applies to motor vehicle registration periods beginning after December 31, 1999.
