A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING COUNTY COMMISSIONS TO AUTHORIZE USE BY COUNTY EMPLOYEES OF AN INSURANCE CONTRACT OR PLAN IN CONJUNCTION WITH MEDICAL CARE SAVINGS ACCOUNTS; PROVIDING FOR DEDUCTION OF CONTRIBUTIONS AND FOR USE OF EMPLOYEE AND EMPLOYER CONTRIBUTIONS FOR THE PURPOSES OF THE ACCOUNT; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Counties authorized to use medical care savings accounts in conjunction with insurance contract or plan. (1) A county commission may authorize the use of an insurance contract or plan offering medical, dental, and vision coverage for county employees, to be used in conjunction with medical care savings accounts established by or for county employees pursuant to Title 15, chapter 61. If authorized pursuant to this section, an employee may upon written request have amounts deducted from the employee's salary or wage, from whatever source the salary or wage is paid, and deposited, together with any portion of the employer's contribution paid pursuant to 2-18-703(3), whether or not required for mandatory or elected benefits and designated by the employee, into the employee's medical care savings account. The county commission may execute any contract necessary for the administration of the program authorized by this section. An insurance contract or plan authorized by a county commission to be used in conjunction with a medical care savings account pursuant to this section is subject to the applicable mandatory coverage provisions provided in Title 33 and this chapter.
(2) As used in this section, "medical care savings account" has the meaning provided in 15-61-102.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 18, part 7, and the provisions of Title 2, chapter 18, part 7, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective on passage and approval.
