A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE II, SECTION 10, OF THE MONTANA CONSTITUTION TO PROVIDE THAT NEITHER THE STATE NOR ANY PERSON, FIRM, CORPORATION, OR INSTITUTION SHALL DIVULGE INDIVIDUALLY IDENTIFIABLE HEALTH CARE INFORMATION EXCEPT WHEN THE MERITS OF DISCLOSURE CLEARLY EXCEED THE DEMAND OF INDIVIDUAL PRIVACY."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Article II, section 10, of The Constitution of the State of Montana is amended to read:

"Section 10.  Right of privacy. The right of individual privacy is essential to the well-being of a free society and shall not be infringed without the showing of a compelling state interest. Neither the state nor any person, firm, corporation, or institution shall divulge individually identifiable health care information except when the merits of disclosure clearly exceed the demand of individual privacy."



     NEW SECTION.  Section 2.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2000 by printing on the ballot the full title of this act and the following:

     [] FOR extending the constitutional right of privacy in individually identifiable health care information to nongovernmental persons, firms, corporations, and institutions.

     [] AGAINST extending the constitutional right of privacy in individually identifiable health care information to nongovernmental persons, firms, corporations, and institutions.
