A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE BOARD OF ENVIRONMENTAL REVIEW TO DEVELOP SULFUR DIOXIDE EMISSION CONTROL PLANS; REDUCING THE NUMBER OF ALLOWABLE EXCESS CONCENTRATIONS OF THE AMBIENT SULFUR DIOXIDE STANDARD; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Sulfur dioxide emission control plans. In areas where multiple industrial sources of sulfur dioxide are located in close proximity, the board shall develop a sulfur dioxide emission control plan for each source in a manner consistent with federal emission control plans for sulfur dioxide.



     NEW SECTION.  Section 2.  Limitation on excess concentrations of sulfur dioxide standard. A person may not cause or contribute to concentrations of sulfur dioxide in the ambient air that exceed the 1-hour average standard adopted by the board more than three times in any 12 consecutive months.



     NEW SECTION.  Section 3.  Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 75, chapter 2, part 2, and the provisions of Title 75, chapter 2, part 2, apply to [sections 1 and 2].



     NEW SECTION.  Section 4.  Effective date. [This act] is effective on passage and approval.
