A BILL FOR AN ACT ENTITLED: "AN ACT CREATING AN ANNUAL LICENSE FEE FOR A MONTANA SEED GROWER WHO SELLS SEED FROM THE SEED GROWER'S OWN PRODUCTION IF IN PACKAGES OF OVER 10 POUNDS, IF THE SALES EXCEED $1,000 ANNUALLY, OR IF THE SEED IS SOLD TO OTHER THAN A LICENSED MONTANA SEED DEALER, CONDITIONER, OR LABELER; SUBMITTING THE FEE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Annual license fee for Montana seed grower selling from production. The annual fee for licensure of a Montana seed grower selling only the seed grower's own production if in packages of over 10 pounds, if the sales exceed $1,000 annually, or if the seed is sold to other than a licensed Montana seed dealer, conditioner, or labeler is $50 a year.
NEW SECTION. Section 2. Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:
SHALL A NEW TAX, DESCRIBED AS FOLLOWS, BE IMPOSED?
[] FOR establishing an annual license fee of $50 for certain Montana seed growers selling only their own production.
[] AGAINST establishing an annual license fee of $50 for certain Montana seed growers selling only their own production.
NEW SECTION. Section 3. Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then sections 2 and 5 are void.
NEW SECTION. Section 4. Codification instruction. Section 1 is intended to be codified as an integral part of Title 80, chapter 5, part 2, and the provisions of Title 80, chapter 5, part 2, apply to section 1.
NEW SECTION. Section 5. Effective date. This act is effective upon approval by the electorate.
