SENATE BILL NO. 254

A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE ELECTORATE AN AIR QUALITY OPERATION FEE INCREASE; PROVIDING A CONTINGENT VOIDNESS PROVISION; AND PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Annual operating fee for air contaminants. There is an air quality operation fee of $400 plus $29.90 a ton for each air contaminant, not to exceed a total of $250,000.
NEW SECTION. Section 2. Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:
SHALL THE AIR QUALITY OPERATION FEE BE INCREASED ANNUALLY BY $47.58 PLUS $15.75 A TON EMITTED, NOT TO EXCEED A TOTAL OF $250,000, IN THE FOLLOWING MANNER?
[] FOR increasing the air quality operation fee from $367.88/ton plus $14.15/ton, not exceeding $200,000, to $400 plus $29.90/ton, not exceeding $250,000.
[] AGAINST increasing the air quality operation fee from $367.88/ton plus $14.15/ton, not exceeding $200,000, to $400 plus $29.90/ton, not exceeding $250,000.
NEW SECTION. Section 3. Contingent voidness. If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, including the provision requiring a public vote on tax increases, is declared invalid, then this act is void.
NEW SECTION. Section 4. Effective date. If approved by the electorate, this act is effective on the date of approval.
