A BILL FOR AN ACT ENTITLED: "AN ACT ALLOWING THE COMMISSIONER OF INSURANCE TO WAIVE THE EXAMINATION REQUIREMENT FOR APPLICANTS FOR A CONSULTANT LICENSE WHO HAVE ACQUIRED THE REQUIRED COMPETENCY THROUGH THE ATTAINMENT OF A RECOGNIZED PROFESSIONAL INSURANCE DESIGNATION AS SPECIFIED BY RULE BY THE COMMISSIONER OF INSURANCE; AND AMENDING SECTION 33-17-505, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 33-17-505, MCA, is amended to read:

     "33-17-505.  Qualification -- fee. (1) In order to determine the competency of an applicant for a consultant license, the commissioner shall require the applicant to pass an examination.

     (2)  The fee for taking the consultant license examination is $50. The commissioner shall deposit all fees collected in the general fund. The fee for taking a second or subsequent examination may be no more than the cost of administering the examination, not to exceed $50.

     (3)  (a) An applicant is not required to take an examination if the applicant has acquired the required competency through the attainment of a recognized professional insurance designation.

     (b) The commissioner may SHALL adopt rules specifying which professional insurance designations demonstrate the required competency referred to in subsection (4)(a) (3)(A)."
