A BILL FOR AN ACT ENTITLED: "AN ACT INCREASING THE RESIDENT COMBINATION FISHING AND HUNTING ACCESS/HABITAT WILDLIFE CONSERVATION LICENSE BY $4; SUBMITTING THE FEE INCREASE TO THE ELECTORATE; PROVIDING A CONTINGENT VOIDNESS PROVISION; PROVIDING A TERMINATION DATE; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Resident combination fishing and hunting access/habitat WILDLIFE CONSERVATION license. Resident combination fishing and hunting access/habitat WILDLIFE CONSERVATION licenses may be purchased for a fee of $8.



     NEW SECTION.  Section 2.  Submission to electorate. This act shall be submitted to the qualified electors of Montana at the tax election to be held in 1999 by printing on the ballot the full title of this act and the following:

SHALL THE RESIDENT COMBINATION FISHING AND HUNTING ACCESS/HABITAT WILDLIFE CONSERVATION LICENSE FEE TAX BE INCREASED ANNUALLY BY $4 IN THE FOLLOWING MANNER?

     [] FOR increasing resident combination fishing and hunting access/habitat WILDLIFE CONSERVATION licenses by $4, using the increase to encourage public access to private lands for hunting purposes.

     [] AGAINST increasing resident combination fishing and hunting access/habitat WILDLIFE CONSERVATION licenses by $4, using the increase to encourage public access to private lands for hunting purposes.



     NEW SECTION.  Section 3.  Contingent voidness. (1) If Constitutional Initiative No. 75, enacting Article VIII, section 17, of the Montana constitution, is declared invalid, then this act is void.

     (2) If LC 560 SENATE BILL NO. 338, creating resident combination fishing and hunting access/habitat WILDLIFE CONSERVATION licenses, is not passed and approved, then this act is void.



     NEW SECTION.  Section 4.  Termination. This act terminates March 1, 2006.



     NEW SECTION.  Section 5.  Effective date. If approved by the electorate, this act is effective March 1, 2000.
