     50-44-102. (Temporary) Establishment of program. (1) The department of public health and human services shall establish a program to provide treatment to persons suffering from chronic renal diseases, including dialysis and other medical procedures and techniques, that may have a lifesaving effect in the care and treatment of the persons. The department shall extend financial assistance to persons suffering from chronic renal diseases in obtaining the medical, nursing, pharmaceutical, and technical services necessary to care for the diseases, including the rental or purchase of home dialysis equipment and supplies.
     (2) The department shall by rule establish standards for determining the amount or duration of financial assistance to be extended to individuals under this program in order that treatment is provided to those who are financially unable to obtain services without causing severe economic imbalance in the family economic unit. The standards must be established without reference to maximum or minimum income levels.
     (3) The department is not liable to any person for a failure to provide financial assistance to that person under this section if sufficient funds are not appropriated by the legislature. (Effective July 1, 2000)

The rules must include standards to ensure that those individuals most in financial or medical need, or both, are the first to receive financial assistance.
     (3) The department is not liable to any person for a failure to provide financial assistance to that person under this section if sufficient funds are not appropriated by the legislature.
