Committee Rule Objections

MAR Notice 42-1052

The committee voted at the August 2022 meeting to informally object to MAR Notice No. 42-1052 by the Alcoholic Beverage Control Division. The notice related to the department's proposed rules relating to implementation of legislation.

The committee held a rule review hearing at the September 2022 meeting and heard from the division administrator for the ABCD. After receiving public comment and further discussion, the committee chose to withdraw its informal objection.

MAR Notice 24-2-390

The committee voted at the June 2022 meeting to formally object to MAR Notice 24-2-390 by the Department of Labor and Industry. The notice related to the department's adopted rule relating to public participation. 

The committee held a rule review hearing at the July 2022 meeting and heard from the Department's chief attorney. After the hearing, some committee members wanted further clarification and understanding on the rule, so the committee chose to continue its objection.

Committee members worked with the Department to receive clarification and withdrew its formal objection of the rule at the August 2022 meeting.

MAR Notice 24-35-376

The committee voted at the November 2021 meeting to informally object to MAR Notice 24-35-376 by the Department of Labor and Industry. The notice relates to the amendment of rules pertaining to the determination of independent contractor status, implementing Senate Bill 367 (2021). 

At the December 9, 2021 meeting, the committee voted to continue its objection to the rule.

At the February 2022 meeting, the Committee heard testimony from the Montana Self Insurers' Association withdrawing its concerns to the rule changes regarding SB 367. The Committee decided not to continue its objection to the rule, however the bill sponsor may consider proposing a committee bill to address lingering concerns.
